Rental Agreement & Liability Waiver
By renting equipment from DelPDX Paddleboard Rentals (“Company”), I acknowledge that I have read, understood, and agree to the following terms and conditions.
Assumption of Risk
Paddleboarding, swimming, and other water activities involve inherent risks, including but not limited to slips, falls, drowning, collisions, changing weather, water conditions, wildlife, and other hazards that may result in injury, illness, property damage, or death.
I voluntarily choose to participate and fully assume all risks associated with these activities.
Health Requirements
I certify that:
- I am at least 18 years of age.
- I am physically capable of participating in paddleboarding and swimming activities.
- I do not have any medical condition that would make participation unsafe.
- I understand that swimming ability is strongly recommended.
Individuals with open wounds, cuts, or other conditions that could increase the risk of infection should avoid participating in water activities until fully healed.
Water & Weather Conditions
DelPDX Paddleboard Rentals carefully selects paddle locations known for relatively calm, beginner-friendly water conditions and monitors weather and water quality whenever practical.
However, natural conditions can change unexpectedly.
If unsafe weather or water conditions exist before your scheduled rental, we may:
- Reschedule your reservation, or
- Issue a refund at our discretion.
The safety of our customers is our highest priority.
Transportation & River Trips: Customers understand that one-way river trips require paddling to the designated take-out location. DelPDX Paddleboard Rentals is not responsible for delays caused by customers stopping along the route, taking longer than expected, or choosing to exit at locations other than the designated pickup point. Customers agree to follow the agreed-upon route unless an emergency requires otherwise.
Safety Equipment
Each rental includes:
- Paddleboard
- Paddle
- U.S. Coast Guard-approved personal flotation device (life jacket)
- Safety leash (when appropriate)
- Permit for paddleboard
Life jackets should be worn at all times while on the water.
Customers agree to follow all safety instructions provided before launching.
Equipment Care
Our equipment is maintained in safe operating condition prior to each rental.
Customers agree to:
- Carry paddleboards whenever possible.
- Do not drag boards across pavement, gravel, concrete, rocks, or other abrasive surfaces.
- Avoid contact with sharp objects, docks, submerged hazards, and rocks whenever practical.
- Exercise reasonable care while using all rental equipment.
Normal wear from responsible use is expected.
Damage Responsibility
Customers are responsible for any damage beyond normal wear and tear.
Equipment is photographed before and after rentals to document its condition.
Examples of damage that may result in repair or replacement charges include, but are not limited to:
- Large gouges
- Deep scratches caused by dragging
- Broken fins
- Cracked boards
- Missing equipment
- Damage caused by negligence or misuse
Minor cosmetic wear and ordinary use are expected and generally do not result in additional charges.
The Company reserves the sole discretion to determine whether damage exceeds normal wear and tear.
Personal Property
Customers are solely responsible for all personal belongings.
Please bring only essential items.
Keys, wallets, phones, jewelry, cameras, and other valuables should be properly secured in waterproof containers or left safely in your vehicle.
DelPDX Paddleboard Rentals is not responsible for lost, stolen, or damaged personal property.
Release of Liability
To the fullest extent permitted by Oregon law, I release and hold harmless DelPDX Paddleboard Rentals, its owners, employees, agents, and representatives from any and all claims, demands, damages, injuries, losses, liabilities, costs, or expenses arising from or related to my participation in paddleboarding activities or the use of rental equipment, including those resulting from ordinary negligence.
This release does not apply to gross negligence, reckless conduct, or intentional misconduct where prohibited by law.
Indemnification
I agree to indemnify and hold harmless DelPDX Paddleboard Rentals from any claims arising out of my actions, negligence, misuse of equipment, or violation of this agreement.
Acknowledgment
By signing below, I acknowledge that:
- I have read this entire agreement.
- I understand the risks associated with paddleboarding.
- I voluntarily assume those risks.
- I understand I am responsible for the rental equipment while it is in my possession.
- I agree to comply with all safety instructions.
- I agree to wear the provided life jacket while on the water.
